minimum standards for state and local correctional facilities. The
standards for state correctional facilities shall be established by
January 1, 2007. The authority shall review those standards
biennially and make any appropriate revisions.
(b) The standards shall include, but not be limited to, the
following: health and sanitary conditions, fire and life safety,
security, rehabilitation programs, recreation, treatment of persons
confined in state and local correctional facilities, and personnel
training."
Having read that, it looks like Schwarzenegger just wants to brag how tough he is on criminals in his literature. This is already a "health condition" issue and even if you could somehow argue that it wasn't, prisoner transportation ought to be within their jurisdiction.
That said, the Pennsylvania bill was much more explicit in its language.
"ยง 5905. Healthy birth for incarcerated women. (a) Duties of correctional institution.--Consistent with established policy and practice, it shall be the duty and responsibility of the correctional institution to provide adequate personnel to monitor the pregnant prisoner or detainee during transport to and from the medical facility and during her stay at the medical facility."
